The risk of getting it wrong

Employers who fail to carry out compliant right to work checks face civil penalties of up to £60,000 per illegal worker. In serious cases, criminal prosecution is possible. Ignorance is not a defence. If the check was not done correctly, the penalty applies.

The rules around what documents are acceptable, and how checks must be conducted, have changed significantly in recent years. A process that was correct in 2020 may not be compliant now.
