Following a strategic review of business operations, one of our clients identified a standalone, part-time role for redundancy.
The role had naturally reduced due to increased digitalisation, automation and improved system efficiencies. Manual input was no longer required at the same level. The proposal was driven by legitimate business needs, cost control and operational efficiency, not performance or capability.
During consultation, the employee raised concerns about potential age discrimination. She stated that “AI” and an informal “legal advisor” had suggested the redundancy implied she was unable to adapt to digital systems. She also highlighted her proximity to retirement age and concerns about securing alternative employment.
From the outset, it was critical to evidence and communicate clearly that:
- The redundancy was role-based, not person-based
- Digital transformation had removed the need for the role itself, not the capability of the individual
- Age was not a factor in any stage of decision-making
The employee’s concerns appeared to stem from inaccurate or biased inputs into AI tools, which generated misleading guidance, including incorrect references to case law.
With structured HR support from enlightenHR, the client was able to:
- Maintain a fair and compliant consultation process
- Address allegations of age discrimination early and robustly
- Provide evidence-based responses to mitigate risk
- Prevent escalation to grievance, appeal or ACAS Early Conciliation
Without clear HR guidance, the situation had the potential to escalate into a complex and costly dispute based on misinformation rather than fact.
The redundancy process concluded successfully, with no litigation or formal disputes raised.
Why This Matters
This case highlights a growing challenge for employers.
When employees feel upset or uncertain, AI-generated “legal advice” can amplify risk, often without context or accuracy.
Having structured, expert HR guidance ensures that legitimate business decisions are protected by clear process, documentation and confident communication.
If you are navigating redundancy, restructure or any sensitive people matter, early advice prevents unnecessary escalation.
